By accessing or using our Services, you agree to be bound by these terms and conditions. If you do not agree with any provision of this Agreement, you must immediately discontinue your use of the Services.

1. General Provisions

1.1. Agreement Acceptance
By downloading, installing, or using the Services, you acknowledge that you have read, understood, and agree to these Terms of Use in their entirety. If you do not accept these terms, you do not have permission to use the Services.

1.2. License Grant
We grant you a non-transferable, non-exclusive, and limited license to use our Services on your personal devices in accordance with the terms of this Agreement. You may use the Services for personal, non-commercial purposes only.

1.3. License Scope
The license allows you to:

Install the Services on an unlimited number of personal devices for your use, as long as you comply with this Agreement.

1.4. Definitions

Subscription: Recurring payment for continued access to paid services within the app.
User: Any person who agrees to and accepts the terms of this Agreement and uses the Services.
Program: Any software, applications, and related materials provided by us that allow you to access our Services.

2. Terms of Use

2.1. Intellectual Property Rights
All content, including but not limited to the software, text, graphics, images, and trademarks, included in the Services is protected by applicable copyright and intellectual property laws and is the property of Family Tree App or its licensors.

2.2. User Rights and Restrictions
You may:

Reproduce and install the Services on your personal devices for non-commercial use.
Modify, copy, or distribute the Services only for personal use, without altering any part of the Program or its functionality.

You may not:

Use the Services in violation of any intellectual property rights, including the unauthorized reproduction, modification, or distribution of any materials.
Use the Services for commercial purposes without our explicit written consent.

2.3. Subscription Plans
Some features of the Services are available under paid subscription plans. These plans may offer additional functionality, content, or services. The details of subscription plans, including prices, duration, and features, will be made available in the app interface and on the platform where you download the app (e.g., the app store).

2.4. Free Trial and Subscription

We may offer a free trial period for certain features or subscription plans. The duration and terms of the free trial will be clearly stated at the time of activation.
After the free trial period ends, the subscription will automatically convert to a paid subscription unless canceled before the last day of the free trial.
Subscriptions will be automatically renewed at the end of each billing cycle. You can cancel your subscription at any time through the app's account management settings.

2.5. Automatic Renewal

If you subscribe to a paid plan, we will automatically renew your subscription at the end of each term (e.g., monthly or annually), and the payment will be charged to the payment method linked to your account.
You can disable auto-renewal by managing your subscription settings in the app or your app store account before the renewal date.

2.6. Subscription Payment

Payments for subscription plans are charged in advance, and no refunds are provided once a payment is made.
You are responsible for ensuring that your payment details are correct, and for updating them if necessary.

3. Rights and Obligations of the Parties

3.1. User Rights
As a User, you have the right to:

Use the Services in accordance with this Agreement and the intended purpose.
Install the Services on multiple devices for personal use.
Reproduce and distribute copies of the Services for non-commercial purposes, provided the content is unaltered and properly attributed to the original source.

3.2. User Obligations
As a User, you agree to:

Use the Services only for lawful purposes.
Not violate the intellectual property rights of Family Tree App or third parties.
Not engage in any activity that may disrupt or interfere with the proper functioning of the Services.

3.3. Company Rights
We reserve the right to:

Modify, update, or discontinue any part of the Services without notice at our discretion.
Provide updates and patches to improve the functionality and security of the Services.
Monitor and enforce compliance with these Terms of Use and suspend or terminate accounts in cases of violations.

3.4. Company Obligations

4. Limitation of Liability

We are not responsible for any loss of data, including genealogical information or other content, caused by system failures, application errors, or user actions.

4.3. No Warranty of Uninterrupted Service
We do not guarantee that the Services will be uninterrupted or error-free. We may, from time to time, perform maintenance or updates that may cause temporary disruptions in service.

4.4. Indemnification
You agree to indemnify and hold harmless Family Tree App, its affiliates, and its employees from any claim, loss, or liability arising out of your use of the Services or any violation of this Agreement.

5. Termination

5.1. Termination by User
You may terminate your use of the Services at any time by uninstalling the app or canceling your subscription through your account settings.

5.2. Termination by Company
We may suspend or terminate your access to the Services if you violate any terms of this Agreement or engage in unlawful or disruptive behavior. We may also terminate your account due to non-payment of subscription fees.

5.3. Consequences of Termination
Upon termination of this Agreement, your right to use the Services will cease immediately, and you must uninstall the app from your devices.

6. Miscellaneous

6.1. Amendments to the Agreement
We may modify or update this Agreement at any time. Any changes will be posted on our website and in the app. By continuing to use the Services after changes are made, you agree to the revised terms.

6.2. Governing Law
This Agreement shall be governed by the laws of the jurisdiction in which Family Tree App is based, without regard to its conflict of law principles.
